Welcome to Aloomah. These Terms of Service (“Terms”) govern your use of our website and services, including any content, functionality, and services offered on or through aloomah.io (the “Site”). By accessing or using the Site, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Site.

1. General Information

• Eligibility: You must be at least 18 years old to use our Site. By using our Site, you represent and warrant that you meet this eligibility requirement.

• Prohibited Activities: You agree not to engage in any of the following prohibited activities:

3. Orders and Payment

4. Shipping and Delivery

• Shipping: We offer shipping services to both U.S. and international addresses. Shipping costs and delivery times will vary depending on the destination and shipping method selected.
• Delivery: We strive to ensure that your order is delivered in a timely manner. However, we are not responsible for delays caused by factors beyond our control, including but not limited to customs clearance, weather conditions, or carrier delays.

5. Returns and Refunds

• Damaged Items: If your item arrives damaged, please take a picture of the damaged item within 7 days of receiving your order and contact us at support@aloomah.io with your order number and photos of the damage. We will review your claim and provide return instructions. Once we receive the damaged item, we will send a replacement at no additional cost or issue a full refund, including shipping costs, within 15 business days.
• Product Quality Issues: If you are not satisfied with the product’s quality, or it appears damaged or of poor quality, email us at support@aloomah.io with your order number and photos of the item within 7 days of receiving your order. We will discuss your case and ensure you are either provided a replacement or a refund based on the situation.
• General Return Guidelines: Returns are only accepted for damaged or poor-quality items reported within 7 days of receiving your order. Please allow up to 15 business days for the processing of refunds or replacements once your return is received and approved.

6. Intellectual Property

• Ownership: All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Aloomah or its content suppliers and is protected by U.S. and international copyright laws.
• Trademarks: Aloomah and other marks displayed on our Site are trademarks of Aloomah. You are not permitted to use these trademarks without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, Aloomah and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Site.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the Site.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site.

You agree to indemnify, defend, and hold harmless Aloomah, its affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
